Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your access to and use of the FitnessGO mobile application and related services (the “Service”), provided by Viral App Brewery Pte Ltd, 20 Collyer Quay #11-05, Singapore 049319 (“FitnessGO”, “we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (https://fitnessgo.app/privacy). If you do not agree, do not use the Service.

2. Eligibility

- You must be at least 18 years old to use the Service. If you are between 13 and the age of majority, your parent/guardian must accept these Terms for you and is responsible for your use.

- You may use the Service only in compliance with these Terms and applicable laws.

3. Health and Safety; No Medical Advice

- The Service provides general health, nutrition, fasting, and fitness information for educational purposes only. It is not medical advice, diagnosis, or treatment. Always consult a qualified health professional regarding any medical questions, diet, fasting, or fitness regimen.

- Do not disregard professional medical advice because of information in the Service. If you have a medical emergency, call your local emergency number.

4. Fasting and Contraindications (Important)

Fasting may not be appropriate for everyone. Consult a healthcare professional before changing diet or fasting patterns. Without limitation, fasting may be unsafe if you:

- Are pregnant, trying to conceive, or breastfeeding.

- Are underweight, have a history of eating disorders, or experience irregular menstruation.

- Are a child/adolescent, older adult, or otherwise frail.

- Have diabetes (Type 1/2), hypoglycemia, low blood pressure, cardiovascular, kidney, liver, or gastrointestinal disease, or other chronic conditions.

- Take medicines affected by food/blood sugar/blood pressure.

- Perform intense physical activity, operate heavy machinery, or perform tasks requiring sustained concentration while fasting.

This list is not exhaustive. You are solely responsible for determining whether fasting, dietary changes, or exercise are safe for you.

5. Subscriptions, Trials, Billing, and Cancellation

- Certain features require a paid subscription (“Premium”). Pricing, billing period, and features are shown in‑app and may vary by region/platform.

- Free trials auto‑convert to paid unless canceled at least 24 hours before trial end.

- Subscriptions auto‑renew unless canceled at least 24 hours before the end of the current period. Your account may be charged within 24 hours before renewal.

- Manage/cancel via your platform account settings (Apple App Store/Google Play). Deleting the app does not cancel your subscription.

- Billing/refunds are handled by the app store; we generally cannot issue refunds directly.

6. In‑App Purchases and Restore Purchases

- Purchases are processed by platform providers (Apple/Google) and/or subscription infrastructure (e.g., RevenueCat).

- “Restore Purchase” allows re‑associating past entitlements with your device/account, subject to platform/provider availability.

- Purchase/entitlement information may be synchronized via RevenueCat; their terms apply as applicable.

7. User Accounts and Security

- You are responsible for all activity on your account and for safeguarding your device and credentials. Notify us at fyn@viralappbrewery.com if you suspect unauthorized access.

8. Acceptable Use

You agree not to:

- Use the Service unlawfully; upload illegal, infringing, harmful, defamatory, obscene, hateful, or otherwise objectionable content.

- Interfere with or disrupt the Service; introduce malware; attempt unauthorized access.

- Reverse engineer or circumvent security or access controls, except as permitted by law.

9. User Content and License

- You retain ownership of content you submit (“User Content”). You grant FitnessGO a worldwide, non‑exclusive, royalty‑free, sublicensable, transferable license to use, reproduce, display, and distribute User Content solely to operate and improve the Service.

- You represent you have rights to your User Content and that it does not violate law or third‑party rights. We may remove content that violates these Terms.

10. Intellectual Property

- FitnessGO and licensors own all rights in the Service and its content (excluding User Content). Do not copy, modify, distribute, sell, or lease any part of the Service except as permitted.

11. Third‑Party Services and Links

- The Service may link to or integrate with third‑party sites or services (e.g., app stores, RevenueCat, analytics, hosting). We are not responsible for third‑party services; their terms apply.

12. Privacy

- Our data practices are described in our Privacy Policy (https://fitnessgo.app/privacy). By using the Service, you consent to those practices.

13. Disclaimers; No Warranties

- THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION, OR THAT CONTENT IS ACCURATE OR COMPLETE.

14. Limitation of Liability

- TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNESSGO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS/REVENUES/DATA/GOODWILL ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

- IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID TO FITNESSGO IN THE 12 MONTHS BEFORE THE CLAIM, OR (II) USD $50.

15. Indemnification

You agree to defend, indemnify, and hold harmless FitnessGO and its affiliates, officers, agents, and employees from claims and expenses (including reasonable attorney’s fees) arising from your use of the Service, your User Content, or violation of these Terms.

16. App Store Terms; Apple EULA

- If you downloaded via Apple App Store, your use is also governed by Apple’s EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

- If these Terms conflict with app store terms, app store terms may control to the extent of conflict.

17. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be posted in‑app or at https://fitnessgo.app/terms. Continued use after changes become effective constitutes acceptance.

18. Termination

We may suspend or terminate access for any reason, including violations of these Terms. Sections intended to survive termination will continue to apply.

19. Governing Law and Venue

These Terms are governed by the laws of Singapore. You agree to the exclusive jurisdiction and venue of courts located in Singapore for disputes arising out of or relating to these Terms or the Service.
